CONTEST REGULATIONS

"Win a trip to the mountains for 2 people"

§1. Contest Organizer

1. The organizer of the contest called "Win a trip to the mountains for 2 people" (the "Contest") is MOUNTAIN SHELTER FOGELE&SZTARBAŁA limited liability company headquartered in Krakow, ul. Opatkowicka 10B, 30-499 Kraków, NIP: 6793361858, hereinafter referred to as the "Organizer".

2. The Contest is organized via the Organizer's profile on Instagram.

3. The Contest is not sponsored, supported, administered, or associated with Instagram, Facebook, Meta Platforms, Inc., or entities from the Meta group.

4. Instagram, Facebook, and Meta are not responsible for the organization, conduct, resolution, or execution of the Contest.

5. By participating in the Contest, the Participant fully releases Instagram, Facebook, and Meta from any liability related to the Contest.

§2. Contest duration

1. The Contest runs from the day the contest post is published on the Organizer's profile until 30.05.2026 at 23:59 Polish time, upon reaching a minimum of 50 comments.

2. Entries submitted after the deadline indicated in section 1 will not be considered.

3. The Contest results will be announced by 03.06.2026 in a comment under the contest post, in a post, reel, or story on the Organizer's profile.

4. Contest vouchers can be redeemed until 30.09.2026, subject to availability of facilities and exclusions of dates indicated in these Regulations.

§3. Contest participants

1. Only adults with an active Instagram account can participate in the Contest.

2. Participation in the Contest is voluntary and free of charge.

3. Participation in the Contest implies acceptance of these Regulations.

4. Employees of the Organizer, their immediate family members, owners of apartments, cottages, and facilities cooperating with the Organizer, as well as persons directly involved in preparing or conducting the Contest cannot participate.

5. One person can receive only one prize in the Contest.

6. The Organizer may refuse to award a prize to a person who does not meet the Contest participation conditions or provided data that prevent contact or prize fulfillment.

§4. Contest participation rules

1. To participate in the Contest, the Participant should post a comment under the contest post stating with whom they want to go to the mountains and why they want to spend this time with that person.

2. The Participant can tag a person in the comment with whom they would like to go, but tagging is not a participation condition nor does it alone affect the assessment of the entry.

3. Following the Organizer's profile, liking the post, saving the post, sharing the post, or tagging others are not conditions for contest participation or prize receipt.

4. Winning is not determined by the number of likes on the comment, reactions, shares, or activity of other Instagram users.

5. Contest entries must not contain offensive, vulgar, unlawful content, infringing third-party rights, personal rights, discriminatory, inciting violence, contrary to good customs or Instagram/Meta rules.

6. Participants must not tag people contrary to Instagram/Meta rules, especially tagging people in photos or materials where they do not appear.

7. The Organizer reserves the right to exclude from the Contest any entry violating the Regulations, laws, good customs, third-party rights, or Instagram/Meta rules.

§5. Selection of winners

1. Winners of the Contest will be selected by a jury appointed by the Organizer.

2. The jury will choose based on subjective evaluation considering creativity, authenticity, emotionality, originality, and compliance with the Contest theme.

3. The Contest is not a lottery, game of chance, mutual bet, or other gambling game. The winners are not chosen by chance or draw.

4. Three winners will be selected in the Contest.

5. The jury's decision regarding winner selection is final within the contest procedure, without excluding the Participant's right to file complaints or claims under general rules.

6. After announcing results, the winner must contact the Organizer via private message on Instagram or other means indicated by the Organizer within 7 calendar days from the announcement.

7. Failure to contact within the period may result in losing the prize and selecting another winner.

8. If the winner does not meet the conditions or refuses to provide necessary data for prize fulfillment, the Organizer may refuse to issue the prize and select another winner.

§6. Prizes

1. The prizes are 3 vouchers for a 3-day stay for 2 people, including 2 nights at Mountain Shelter facilities.

2. The prizes to win are: a) a voucher for a stay at Mountain Shelter Apartments; b) a voucher for a stay at Mountain Shelter Zakopane; c) a voucher for a stay at Mountain Shelter Osada Gawlaki.

3. The Organizer reserves the right to specify a particular apartment, cottage, or premises within a prize based on availability, booking schedule, and operational possibilities.

4. The winner may indicate a preferred facility or date, but this is not binding for the Organizer.

5. Each voucher covers a stay for up to 2 people for 2 nights.

6. The voucher can be redeemed until 30.09.2026 only on available dates and after prior agreement with the Organizer.

7. The voucher is not valid during the periods: 04.06–07.06.2026 and 01.07–21.08.2026.

8. The prize date depends on the availability of the facility. The Organizer does not guarantee availability of every date selected by the winner.

9. The winner should report the preferred stay date at least 14 days in advance.

10. The prize is not exchangeable for cash or other services.

11. The prize is not transferable to another person without the Organizer’s prior consent.

12. The prize includes only accommodation for 2 people for 2 nights. It does not cover travel costs, meals, local/tourist tax, parking, tourist attractions, deposits, additional services, or other costs not expressly covered by the voucher.

13. The voucher will be sent to the winner electronically after providing the necessary data for its issuance and stay realization.

§7. Tax matters

1. The value of a single prize does not exceed PLN 2,000 gross.

2. The Organizer will perform the tax classification of the prize according to applicable tax law.

3. If tax liability arises from the prize under applicable law, the Organizer reserves the right to obtain from the winner the data necessary for proper tax settlement and payer obligations.

4. Refusal to provide necessary data, if such obligation arises, may result in refusal to award the prize.

§8. Prize fulfillment and stay confirmation

1. Prize fulfillment requires agreeing with the Organizer on an available stay date and providing data necessary for booking.

2. By entering the Contest, the Participant acknowledges that if they become a winner, prize fulfillment involves the obligation to transparently confirm the stay.

3. The winner commits to creating a short photo or video material from the stay at Mountain Shelter. The material can show the facility, views, stay elements, details, or the winner’s stay in a way that does not require revealing the winner’s or accompanying person’s image.

4. The winner should publish the material on their Instagram profile as a post, reel, story, or other equivalent publication agreed with the Organizer, tagging the Organizer’s profile during the stay or within 7 days of stay end.

5. The publication should transparently indicate that the material relates to winning the Organizer’s Contest.

6. If the winner does not wish to publish the material on their profile, they may send it directly to the Organizer to confirm prize fulfillment.

7. By sending the material to the Organizer, the winner grants a free, non-exclusive license to publish it on the Organizer’s social media profiles, especially Instagram and Facebook, solely to document prize awarding, announce contest results, and promote the Organizer’s activities.

8. The license includes fixing, digital reproduction, publication, reposting, sharing, and public making available of the material online, especially on the Organizer’s social media.

9. The license is granted without territorial limits for 3 years from the day the material is provided to the Organizer.

10. The winner declares they have rights to the material provided and that its transfer and publication do not infringe third-party rights, including copyrights, image rights, or personal rights.

11. If the material contains the winner’s image, its publication by the Organizer is based on the winner’s consent given by providing the material.

12. If the material contains images of accompanying or other persons, the winner should obtain their consent for publishing and sharing by the Organizer. The winner should not provide materials containing third-party images without such consent.

13. Refusal to fulfill the stay confirmation obligation before prize realization may result in refusal of prize fulfillment and selection of another winner.

§9. Image and publication of winners’ data

1. The Participant acknowledges that in case of winning their Instagram profile name may be published by the Organizer to announce the Contest results.

2. The Organizer may publish the winner’s profile name and tag their profile in materials informing about the Contest results and prize fulfillment.

3. The Organizer will not publish the winner’s address data.

4. Publishing the winner’s profile name aims to transparently announce Contest results and confirm prize awarding.

5. Publishing the image of the winner or accompanying persons is not required to participate or confirm stay, provided the winner submits or publishes stay confirmation material in another way.

§10. Copyrights for contest entries

1. The Participant declares that the contest comment content is their authorship and does not infringe third-party rights.

2. The Participant is responsible for the content of their contest entry.

3. The Participant grants the Organizer a non-exclusive, free license to use the contest entry for conducting the Contest, announcing results, promoting the Contest, and publishing on the Organizer's social media profiles.

4. The license includes publication, quoting, sharing, digital reproduction, and public availability of the content on the internet, especially on the Organizer’s Instagram and Facebook profiles.

5. The license is granted without territorial limits for 3 years from the Contest's end date.

6. The Organizer commits to using contest entries in a way that does not infringe the Participants' personal rights.

7. In case of third-party claims against the Organizer regarding the Participant's contest entry, the Participant agrees to cooperate with the Organizer to clarify the matter and is liable under general rules for claims resulting from their culpable violation of rights.

§11. Complaints

1. Complaints regarding the Contest can be submitted within 14 days from the announcement of results via private message on the Organizer's profile or by email at: kontakt@mshelter.pl.

2. The complaint should include the Participant's name or profile name, case description, and contact details to provide a response.

3. Complaints will be processed within 14 days from receipt by the Organizer.

4. The response to the complaint will be sent to the Participant unless another contact address is provided.

5. The complaint process does not exclude the Participant’s right to pursue claims under general rules.

§12. Personal data

1. The data controller of Participants' personal data is MOUNTAIN SHELTER FOGELE&SZTARBAŁA sp. z o.o. with headquarters in Krakow, ul. Opatkowicka 10B, 30-499 Kraków, NIP: 6793361858.

2. Contact for data protection matters is available at email: iod@mshelter.pl.

3. Personal data will be processed for the purposes of conducting the Contest, receiving entries, selecting winners, announcing results, contacting winners, prize fulfillment, handling reservations and complaints, fulfilling legal obligations of the Organizer, and defense against potential claims.

4. Personal data may include the Instagram profile name, contest entry content, contact data provided by the winner, data necessary for voucher issuance and stay fulfillment, reservation handling data, and if the material contains image data – the appearance of persons shown.

5. The legal basis for data processing is Art. 6(1)(b) GDPR for participation and Regulation fulfillment, Art. 6(1)(c) GDPR for legal obligations of Organizer, and Art. 6(1)(f) GDPR for Organizer’s legitimate interest in conducting the Contest, announcing results, promoting activity, handling complaints, and defending claims.

6. Personal data will be stored for the time necessary to conduct the Contest, fulfill prizes, and handle complaints, and subsequently for periods required by law or statute of limitations for claims.

7. Winner’s personal data may be disclosed to entities cooperating with the Organizer only to the extent necessary to fulfill the prize, reservation handling, IT, accounting, legal services, or legal obligation performance.

8. The Participant has the right to access, rectify, delete, restrict processing, object to processing, and lodge a complaint with the Personal Data Protection Office.

9. Providing data is voluntary but necessary to participate, contact the winner, announce results, and fulfill the prize.

§13. Final provisions

1. The Regulations are available throughout the Contest duration in a place specified by the Organizer.

2. The Organizer reserves the right to change the Regulations if necessary due to technical, organizational, legal, or other reasons beyond the Organizer's control, provided changes do not infringe Participants' acquired rights.

3. The Organizer reserves the right to interrupt, cancel, or change Contest rules due to important organizational, technical, or legal reasons, provided Participants' acquired rights are not infringed.

4. Matters not regulated by these Regulations are governed by Polish law.

5. The Regulations come into effect on the date of the contest post publication.
